The issue has become an unprecedented legislative agenda, with an increasing number and scope of bills focused on transgender issues. With over 300 legislation submitted in 33 states this year alone these measures are aimed at limiting transgender and wider lesbian, gay, bisexual, transgender & queer (LGBTQ) rights. The number of such bills filed in 2022 was more than double, showing the Republican party’s growing interest in limiting the rights of LGBTQ individuals.
These legislation prohibit instructors from using pronouns that correspond to a student’s gender identification prohibit trans girls from participating on girls‘ sports teams, and compel trans persons to use the toilet matching to their sex assigned at birth.However the emphasis this year is on banning gender-affirming care, with 97 bills introduced in 27 states. Gender-affirming care covers various treatments, including puberty blockers, hormone therapy and, in exceedingly rare cases for trans people under 18 surgery. Medical associations consider such healthcare life-saving and call these bills transphobic.

Opponents of transgender rights argue that the gender given at birth is unchangeable and doubt the dominant views of medical associations with specialities in paediatrics endocrinology, and mental health. They argue that the government must step in to protect parents and professionals from causing irreversible harm to children. However, transgender supporters argue that such actions are punitive, especially given the difficulties in obtaining therapy owing to expense, a lack of family support, or difficulty locating a therapist.

It’s not just the legislators but Republican voters too who have expressed concern and support for these bills. Republicans including former President Donald Trump have embraced restricting trans rights ahead of the 2024 White House race which trans advocates fear will harm transgender children.
The Heritage Foundation, a conservative think tank supports the proposed legislation in several states, although some bills such as those that seek criminal liability for doctors and parents might be “very draconian.” In certain cases Republican legislators seek to charge parents and clinicians with child abuse if they provide therapy, which trans advocates consider excessive.

Governors in South Dakota and Utah have already signed gender-affirming treatment prohibitions proposed by state legislatures this year into law. Legislation in Idaho, Missouri & Wyoming would classify such treatment as felony child abuse, while legislation in Tennessee and Texas would classify it as abuse under family law. Tennessees Republican led Senate approved a measure on Monday that would prohibit doctors from delivering gender affirming therapy to anybody under the age of 18.

Transgender children and their parents have testified in many states against the proposed legislation describing how gender-affirming care has changed their lives and fearing the impact of the bills which have proliferated despite federal courts blocking bans passed in Arkansas in 2021 and Alabama in 2022.
According to a data study conducted last year by health technology startup Komodo Health Inc in collaboration with Reuters, fewer than 15% or around 3,500 kids diagnosed with gender dysphoria from 2017 to 2021, got puberty blockers or hormone therapy.
While these bills have created a divide in the country, with supporters arguing that transgender rights harm children and opponents advocating for the well-being and protection of trans children, it’s essential to look at the facts.
